If your business is a sole proprietorship, its debts are your debts. That means a personal bankruptcy can include supplier bills, business credit cards and equipment loans along with household debt. If the business is a corporation or LLC, its debts are separate, but any debt you personally guaranteed can still follow you. We sort out which is which at the first meeting.
Some owners keep running the business through a Chapter 13 plan. Others close the business and file Chapter 7 for a fresh start.
Some income tax debt can be discharged in bankruptcy if it meets timing rules, including how long ago the return was due and when it was filed. Payroll trust fund taxes and recent taxes generally cannot be discharged, but Chapter 13 can let you pay them over time while stopping levies. Our bankruptcy and taxes page explains the rules.
Once you hire an attorney, debt collectors covered by federal and California collection laws must generally contact the attorney instead of you. Once the case is filed, the automatic stay stops most collection activity, including lawsuits, garnishments and levies.

Business and tax cases take careful documentation. Mr. Hedtke reviews tax transcripts and business records before filing so the case goes smoothly with the trustee.
Sometimes. Sole proprietors can often keep operating during Chapter 13. In Chapter 7, the trustee reviews business assets, so it depends on the type of business and what it owns.
Some older income tax debt can be discharged if it meets the timing rules. Recent taxes and payroll trust fund taxes generally cannot, but Chapter 13 can spread them over the plan.
Usually only for debts you personally guaranteed or co-signed. We review each debt at the consultation.
Three to five years, depending on your income and what the plan needs to pay.
